“Sidhu’s defence claim is that he is a blind courier because the drugs were loaded without his knowledge so he wouldn’t act nervous at the border.
”The version of events presented to Crown counsel by police is a coloured version of the facts … based on the assumption that blind couriers don’t exist,” said defence lawyer Kate Smith, of Winnipeg-based law firm Pinx and Company.
Sidhu has been a professional truck driver since 2015 without incident. He moved to Canada in 2014 and remains an Indian national living in Canada as a permanent resident.
Smith noted none of the evidence collected to date has been disclosed to the defence to be examined.
She also alleged his route and stops were normal for a truck driver.
”Mr. Sidhu disputes who it was that dispatched this load and whether it was his request or, in fact, a request by his company,” Smith said. “Common sense dictates that ... Mr. Sidhu did not have control over what loads the company dispatches him to.””
